Indenture between John H. Milligan, Eliza M. Wardlow, B.F. Milligan, Joel Arrington, Sarah L. Arrington, L.G. Butler, Berry M. and Lydia M. Flemming of the State of Texas, and Jesse Powers of the state of Tennessee

 

This indenture made and entered into the 27th day of September in the year of our Lord one thousand eight hundred and fifty one, between John H. Milligan, Eliza M. Wardlow wife of James Wardlow, B. F. Milligan, Joel Arrington, and Sarah L. his wife, L. G. Butler, Berry M. Flemming and Lydia M. Flemming his wife, all of the state of Texas and Jesse Powers of the other part of the state of Tennessee and County of Hardin.  Witnessith (sic) that the Said John H. Milligan, James Wardlow & Eliza M. Wardlow his wife, B. F. Milligan, Joel Arrington, and Sarah L. Arrington his wife, L. G. Butler, Berry M. Flemming & Lydia M. Flemming his wife, for and in consideration of the sum of four hundred & fifteen (unreadable word) dollars to them in hand paid by the said Jesse Powers, the receipt there of is hereby acknowledged, has given granted bargained and sold and by these presents doth give grant bargain and sell and release convey and confferm (sic) unto the said Jesse Powers & his heirs and assign two certain tracts pieces parcels of land, Situate lying and being in the County of Hardin & State of Tennessee, 1st containing one hundred acres founded on Grant to said Cherry No. 22784 and dated the 11th November 1824 in the 7th Surveyor district & 13th Range & 2nd Section on Rogers Creek and bounded as follows to wit: Beginning at a white oak on the East side of said creek 30 poles East of Jonathan Pickins S. W. corner of an Entry No. 343, thence West with the same 30 poles to an ironwood, said Pickins southwest corner, thence North with the West boundary line four poles to the creek in all 40 poles to a stake in a field, thence West 80 poles to a small ash and red bud, thence South one hundred 156 ½ poles to a forked ironwood, thence East crossing said creek 110 poles to a small black oak & dogwood in a hollow, thence North 116 ½ poles to the beginning.

 

Also one other tract containing by estimation 99 ¾ acres & bounded as follows; Beginning on a stake standing 52 poles North of the northwest corner of said Entry No. 437 (451?), thence West 126 poles to a large white oak, thence South 126 poles to a stake and large chestnut pointer, thence East 126 poles to a white oak stump on the West boundary of said Entry No. 451 (437?), thence North 126 poles to the beginning.  To have and to hold the said tract of land with all and singular the improvements rights (?) lands and appurtenances thereunto belonging or in any way appertaining to him the said Jesse Powers, his heirs, and assigns to his and their only proper use benefit and behalf forever, and the said John H. Milligan, James Wardlow and Eliza M. Wardlow and (sic) his wife, B. F. Milligan, Joel Arrington and Sarah Arrington his wife, Lucy Butler, Berry M. Flemming & Lydia M. Flemming his wife, for their attorney, their heirs, executors, and administrators, doth convant (sic) promise and assign to and with the said Jesse Powers, his heirs, and assigns that the title to the above described tracts or parcels of land he and they will warrant and forever defend against the title claim and demand of all and every person or persons who ever setting up title to the same in law or equity.

 

In witness whereof the said B. F. Milligan as attorney in fact for all the forgoing bargains hath here to set his hand and seal the day and year first above written.

State of Tennessee Hardin County; this day B. F. Milligan of the State of Texas appeared before me and acknowledged in due form of laws that he doth for himself and by powers of attorney duly authenticates signs and seals this above deed for the purpose therein explained.
