Deed, William Meek to John Laws and Fanning A. Jones, 103 acres and 68 acres
From William Meek to John Laws and
Fanning A. Jones. This indenture made
and concluded the 13th July 1833 between William Meeks of the first part
and William J. Mayfield, Robert Church, and John H. Robison of the second part
and John Laws and Fanning A. Jones of the third part all of the County of
Bedford and state of Tennessee. Witnessith that whereas the said William Meek is indebted
to William Mayfield in the sum of $1303.60 due by note as follows,
one note due to said Mayfield by the said Meek for the sum of $600 due the 27th day of August 1832.
One note due by said Meek to Mayfield for the sum of $307 and one half cents due the 17th of April 1832.
One note due by Meek to Mayfield 13th (?) 1832 for $85,
also one note due to said Maxfield for the sum of $18 due the 26th December 1832.
Also one note due by the said Meek to said Maxfield for the sum of $300 due the 13th of July 1833.
Also the said Meek is indebted to the bank of state of
Tennessee in the sum of $512 due about the 15th day of October next with Robert
Church and John H. Robison as his securities to have for the purpose of
securing the payment of said several sums
to said Mayfield and securing the payment of said debt to said bank
____y to the ____ and effect of said several notes and for the further sum of
one dollar to the said Meek in hand paid by the said Laws and Jones the receipt
whereof is hereby acknowledged. Herein
the said Meek has bargained, sold, and conveyed and confirmed unto the said Laws and Jones the
following, tracts or parcels of land situate lying and being in County
aforesaid on the South side of Duck River bounded as follows. Beginning at a
popular on the South side of Duck River in the South boundary line of Jonathan
Greens (Graves?) old tract running East 91 poles to two sugar trees on the bank
of the river thence up the same South 7 poles to a Hickory and Sycamore
opposite the mouth of Wilson's Creek and Adam Meeks beginning corner of a 1000
acre tract. Thence South 2° East with an old-line 160 poles
to a small white Oak and ___ wood.
Thence West 126 poles to a black Oak and ash on the water’s edge of said
River thence up the meanders of the South bank of said River North 46 degrees
east 46 poles, Thence North 14 degrees east 75 poles, Thence North 20 poles,
Thence North 31 degrees west 21 poles, thence north 65 degrees to the beginning
containing 103 acres be the same more or less. (This is the land with
the Meeks Mill)
Also an other tract of land lying on Duck River in the county of Bedford and State aforesaid and bounded as follows to wit. Beginning at 2 bunches of Lynns? a box elder and sugar tree at the head of a Spring in the river bank, running south 86 poles to a stake in a field, James F Meeks corner, thence east passing James F Rogers corner at 22 poles in all 136 ˝ poles to a white oak on the east boundary line of the original tract Thence north with said line 86 poles to a cedar, the south east corner of the said William Meeks 78 tract, thence north (or west?) 136 poles to the beginning, containing 68 acres be the same more or less, to have and to hold the said two tracts as above described with the applotment to the only proper use benefit and liberty of the said Laws and Jones their heirs and assigns from and the said William Meek doth covenant and agree to and with the said Laws and Jones that the before described land and bargained presented with the applotments he will warrant and forever defend against he Claims of all and every person or persons whatever upon the following upheld conditions and tracts that is to say if the said William Meek should fail to pay said Mayfield said several sums above specified and said sums applied payable in the bank as above stated, on or before the first day of January 1834 then and in that case said Laws and Laws or the survivors of them upon being requested to do so in writing from said Mayfield or Robertson or Church shall be authorized to sell said land, several tracts or either of them or as much thereof at will be necessary and sufficient to pay whatever amount of said several sums may remain due and unpaid at the time of said request at public auction, first giving 20 days notice by advertising the same at Chapel Hill and at the mills of said Meek on Duck River and at such other places as they may think proper, and dep__ing the r__ed of __ting this deed of trust shall apply the proceeds of the sale of said several tracts to the payment of said debts in free ___tion to __ several sums and amounts and after paying all the debts above specified the balance if any to pay over to said Meek on his order. It is further that said Jones and Laws or either of them are hereby authorized and required to make and write a deed or deeds of conveyance as trustees of said Meek with general warranty. It is further understood that said trustees or the survivors of them are authorized to sell said tracts or either of them, in part or in the whole tract as they may think proper and advisable.
